The Fifth District Court of Appeals in Mount Vernon has rejected yet another legal challenge to Illinois’ ban on assault weapons and large-capacity magazines. The appeal was filed by Accuracy Firearms against Governor JB Pritzker and other state officials.
The court issued its decision on Friday, May 2nd. Justice James R. Moore stated that in 2023, the Effingham County Circuit Court correctly dismissed the first amended complaint with prejudice, citing adherence to binding precedent from the Illinois Supreme Court.
The legal battle began in January 2023 when Accuracy Firearms filed a five-count complaint in Effingham County, seeking to block enforcement of the assault weapons ban. They requested a temporary restraining order, which the circuit court denied, citing the Illinois Supreme Court’s ruling that the weapons ban did not violate the Illinois Constitution’s equal protection clause.
The case was appealed to the Fifth District Court of Appeals, which upheld the lower court’s decision, ruling that the ban stands and the challenge was without merit.
