The State’s Attorneys in 35 counties in Illinois, including Clay and Jefferson counties, are asking that the U.S. Court of Appeals Seventh Circuit find the state’s ban on assault weapons unconstitutional.
The lead State’s Attorney for the effort is Madison County State’s Attorney Tom Haines. He’s asking that a previous decision handed down by the Federal Court in East St. Louis that would overturn the law be allowed to stand.
Haines noted in the brief that state’s attorneys have a duty to ensure that the laws they enforce are constitutional and that weapons affected by the ban are common and overwhelmingly used for self-defense and recreation, while accounting for just a small part of violent crime in the United States.
