Former murder suspect, 30-year-old Kaine M. Nino of Fairfield has been arrested after allegedly violating the conditions of his pretrial release on an aggravated battery charge. Nino was initially charged with first-degree murder in connection with the March 2024 beating death of 57-year-old Curtis D. Sutton of Fairfield. In September 2025, State’s Attorney Kyle Ellis dismissed the murder charges, but a Class 3 felony aggravated battery charge remained.

According to court records, Nino violated his pretrial release terms when he was arrested for aggravated identity theft, a Class 2 felony. He was booked into the Wayne County Jail shortly after noon on Tuesday.

The original murder case arose from a March 28th, 2024, incident in which Nino and Sutton were involved in a fistfight at a home on the 500 block of S.E. Third Street in Fairfield. Initially, police did not investigate the incident. However, later that day, Sutton sought medical care and was transported to Deaconess Midtown Hospital in Evansville, where he slipped into a coma and died a week later. An autopsy determined that Sutton died from injuries sustained during the altercation.

Nino remains in custody at Wayne County Jail, awaiting a February 3rd hearing to revoke his pretrial release and a pretrial hearing scheduled for February 24th.
