Several cases were resolved Thursday in Wayne County Circuit Court.
68-year-old Rick L. Opell of Fairfield and Jessica A. Tryon, 34, also of Fairfield were each placed on one year of court supervision in separate Class A misdemeanor retail theft cases. Court documents state Opell and Tryon were similarly situated in allegations involving several incidents at the Fairfield Walmart in which merchandise was allegedly not scanned and an unauthorized discount was used. The documents list a cumulative amount of $92.82.
Both defendants stipulated to the facts supporting the retail theft charges, with findings of guilt deferred. Each was ordered to serve 12 months of court supervision, pay a $300 fine plus assessments and share responsibility for $92.82 in restitution to Walmart. Both are also prohibited from having contact with or entering the Fairfield Walmart during their supervision. A review hearing is scheduled for August 31, 2027, at 9 a.m. If the terms of supervision are successfully completed, the cases are to be dismissed.
Taylor L. Cullins, 24 of Fairfield pleaded guilty to unlawful possession of methamphetamine, a Class 3 felony.
Cullins was sentenced to 24 months of probation. Conditions include 30 hours of public service work, an alcohol and drug assessment and any recommended treatment, random drug testing and submission of a DNA sample. Court documents also give Cullins credit for five days previously served in custody. The remaining counts in the case were dismissed.
Daniel BJ Brockett, 49 of Fairfield received 12 months of conditional discharge on a Class B misdemeanor charge of criminal trespass to real property. Court records show Brockett was ordered to pay $250 in restitution to Joshua Lowery and was sentenced to 60 days in the Wayne County Jail, with the jail sentence stayed. The agreement also called for a $500 fine. Brockett was ordered to have no contact with Lowery or the Barnhill Saltwater Disposal Site on U.S. Highway 45 in Fairfield. Count 1 of the case was dismissed as part of the agreement.
