During a recent session of the Wayne County Grand Jury,  a new charge has been added of aggravated battery causing great bodily harm, a Class-3 felony, to the ongoing case against Kaine Nino. Nino was already facing two counts each of first-degree and second-degree murder in connection with the death of 57-year-old Curtis D. Sutton, 57 of Fairfield.

Authorities allege that on March 20th, Nino got into an altercation with Sutton and slammed him to the ground. Initially, the incident was not investigated as a crime. However, Sutton reportedly became ill in the hours following the incident and sought medical attention. He was later transferred to a hospital in Evansville, where he slipped into a coma and died a week later.

An autopsy performed by the Vanderburgh County Coroner determined that Sutton’s death resulted from injuries sustained during the alleged assault.

Nino is currently being held in the Wayne County Jail. His attorney has requested a speedy trial, with a final pretrial hearing scheduled for next Tuesday, September 30th, and a trial date set for October 14th.
